      Romer applied a "tougher" rational basis standard (what O'Connor called "a more searching form of rational basis."). Assuming that standard applies to gays, but not to polygamists or incestophiles (??), the state easily withstands challenges to bans on group marriage on consanquinity because of the lower standard.
